Terms of Service

By using Setform you agree to these terms. They are written in plain English; if a clause is unclear, email setform@proton.me and we will try to explain it.

1. About Setform

Setform is a surf-forecasting site operated by Brian Wilson, an individual based in Switzerland. It is free of charge, run on a non-commercial basis, and is not a registered business. The operator reserves the right to introduce paid access for individuals, for businesses, or both, as set out in section 10, "Pricing and paid access." Forecast data is sourced from Open-Meteo under the Creative Commons Attribution 4.0 licence and modified for presentation.

2. Using the service

You may use Setform for personal, non-commercial purposes. You agree not to:

  • Scrape, crawl, or automate access at a scale beyond ordinary human use.
  • Attempt to break, overload, or otherwise disrupt the service.
  • Attempt to access another user's account or data, or any non-public part of the system.
  • Copy, reproduce, republish, or create derivative works from Setform's source code, design, or written content, except as the law permits.
  • Impersonate any person or misrepresent your identity to the service.
  • Use the service in any way that violates applicable law.

If you wish to redistribute or build on the underlying forecast data, please consult Open-Meteo's own terms and credit them per the CC BY 4.0 licence.

3. Your account

Creating an account is free and optional. If you create one:

  • You are responsible for keeping your password secure and for activity that happens under your account.
  • You agree to provide an email address you control, so that account-related messages (verification, password resets, important notices) reach you.
  • One person, one account.
  • You may delete your account at any time from your account page. Doing so deletes your account and the data stored with it, as described in the Privacy Policy.
  • The operator may suspend or terminate accounts that violate these terms.

4. Forecasts are informational only

Surf conditions are inherently variable and can be dangerous. Setform is an informational tool, not a safety-of-life service.

Forecast data is modelled and may be wrong, late, or unavailable without notice. Do not rely on Setform alone to decide whether it is safe to enter the water. Always consult lifeguards, coast-guard advisories, local authorities, and your own judgment. Your decision to surf is yours alone, as are any consequences that follow.

Setform is not affiliated with any rescue, lifeguard, weather, or maritime authority.

5. Intellectual property

Forecast data is provided by Open-Meteo under CC BY 4.0, modified for presentation. The Setform site, including its source code, visual design, interface, data visualisations, written content, and branding, is © Brian Wilson, all rights reserved. Being able to view the site or its code in a browser does not grant any licence to copy, reproduce, or create derivative works from it.

6. No warranty

Setform is provided "as is" and "as available", without warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, timeliness, completeness, availability, or non-infringement. The operator does not warrant that the service will be uninterrupted, error-free, or free of harmful components, or that any errors will be corrected.

7. Limitation of liability

To the maximum extent permitted by applicable law, the operator shall not be liable for any direct, indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenues, data, goodwill, or other intangible losses, arising out of or relating to your use of (or inability to use) the service, whether based on warranty, contract, tort (including negligence), statute, or any other legal theory, and whether or not the operator has been informed of the possibility of such damage.

This explicitly includes, without limitation, any personal injury, death, or property damage connected to your decision to enter the water or to take any other action informed by a forecast viewed on Setform.

If, despite the above, the operator is found liable to you for any reason, the operator's total liability shall not exceed CHF 50 (Swiss Francs) or the equivalent in your local currency.

8. Rights that cannot be excluded

Nothing in these terms excludes or limits any liability that cannot lawfully be excluded or limited. Sections 6 and 7 apply only so far as the law allows, and are subject to this section.

This includes, without limitation: liability for death or personal injury caused by intent or by gross negligence, which cannot be excluded in advance under Article 100 of the Swiss Code of Obligations; and any liability arising under mandatory consumer-protection or product-liability rules of your country of residence. If you are a consumer in the European Economic Area, the United Kingdom, or Switzerland, your statutory rights are not affected by these terms.

If any part of these terms is found to be unenforceable, that part applies in the narrowest form needed to make it enforceable, or is severed if it cannot be, and the remaining terms continue in full effect.

9. Indemnification

You agree to defend, indemnify, and hold the operator harmless from any claims, damages, liabilities, costs, or expenses (including reasonable legal fees) arising from your violation of these terms or your misuse of the service.

10. Pricing and paid access

Setform is free to use. The operator reserves the right to introduce paid access, paid features, subscription tiers, or paid business and commercial services for individual users, for businesses, or both, at any time.

  • Any free feature may remain free, move to a paid tier, or be replaced, at the operator's discretion. Nothing in these terms obliges the operator to keep any part of the service free.
  • Prices, currencies, and billing terms are shown clearly before you are asked to pay. You are never charged without first agreeing to a specific price. A free account does not enrol you in any paid plan.
  • The operator may offer different prices or access terms to different groups of users.
  • Business and commercial use, for example in-store, venue, or event displays, may be offered under separate terms and pricing.

11. Changes to these terms

The operator may update these terms from time to time. The "Effective" date at the top of this page always reflects the current version.

If a change would meaningfully reduce your rights or increase your obligations, account holders will be notified by email at least 14 days before it takes effect. Other changes take effect when published, shown by an updated "Effective" date. These include corrections, clarifications, renumbering, changes that are in your favour, and changes required by law.

Continuing to use the service after a change takes effect means you accept the updated terms. If you do not accept a change, you may delete your account at any time from your account page.

12. Governing law and jurisdiction

These terms are governed by the laws of Switzerland, excluding its rules on conflict of laws. The competent Swiss courts shall have exclusive jurisdiction over any dispute arising from these terms or from your use of the service, subject to any mandatory consumer-protection rights of your country of residence.
